Who we are

This website, thotavaikuntam.in, is operated by Thota Vaikuntam Art LLP, a limited liability partnership registered in India [CONFIRM: insert LLPIN and registered office address]. In these terms, we, us and our mean Thota Vaikuntam Art LLP. You can reach us at info@thotavaikuntam.in.

These terms, together with our Privacy, Refund and Cancellation, and Shipping policies, apply to every purchase made through this website. By placing an order you agree to them.

What we sell

We sell limited-edition archival prints of works by the artist Thota Vaikuntam. Each print is produced in a fixed edition, and the edition size is stated on the product page. Every print is numbered within its edition (for example 7 of 25) and comes with a Certificate of Authenticity issued by Thota Vaikuntam Art LLP recording the title, edition number and edition size. Once an edition is sold out, no further prints of that work are made. Original works are not sold through this website; enquiries about them are welcome by email.

Placing an order

Adding a print to your cart does not reserve it. When you begin checkout, the print is held for you for a short time [CONFIRM: 15 minutes] while you complete payment; if payment is not completed in that time, the hold is released and the print may be bought by someone else.

Your order is confirmed only when Razorpay has captured your payment and we have sent you a confirmation email with an order number. Until then, no contract exists between us.

We may cancel an order, even after confirmation, if the print is no longer available (for example because the edition sold out while your payment was being processed), if the price or description was displayed incorrectly because of an error, or if we reasonably suspect fraud. If we cancel, we will tell you by email and refund the full amount to your original payment method.

Prices and taxes

All prices are in Indian Rupees and include Goods and Services Tax at the applicable rate [CONFIRM: GSTIN and the GST rate applied to prints]. The price you pay is the price shown at the time you complete checkout. Shipping is free to metro cities in India; international shipping is charged at actual cost, as set out in our Shipping Policy. We may change prices at any time, but changes do not affect orders that have already been confirmed.

A tax invoice will be emailed to you after payment [CONFIRM: whether invoices are generated automatically or sent manually].

Payment

Payments are processed by Razorpay through Razorpay Checkout, by card, UPI, net banking or wallet as offered at the time. Your card number, CVV and UPI PIN are entered directly with Razorpay and are never seen or stored by us. We keep only the Razorpay order and payment identifiers and the payment method type, which we need to match payments to orders and to process refunds.

If money is debited but you do not receive an order confirmation, write to us at info@thotavaikuntam.in with the transaction reference and we will trace the payment. If the payment did not complete, your bank normally reverses it within 5 to 7 business days.

Intellectual property

All artworks, photographs, text and other content on this website are protected by copyright and belong to Thota Vaikuntam or Thota Vaikuntam Art LLP. Buying a print gives you ownership of that physical print only; it does not transfer copyright or any other right in the artwork.

You may display the print privately and may sell or give away the physical print. You may not copy, scan, photograph for publication, reproduce, adapt, print onto other products, mint as a digital token or otherwise commercially exploit the image, in whole or in part, without our written permission.

Colour and representation

We photograph and describe every print as accurately as we can, but the colours you see depend on your screen, its settings and the light you are in. Small differences in colour, tone and canvas texture between the screen image and the printed work, and between impressions within an edition, are inherent to archival printing and are not defects. Stated dimensions are approximate [CONFIRM: tolerance, for example within 5 millimetres].

Your responsibilities

You must be at least 18 to buy from this website and must give us accurate contact and delivery details. We are not responsible for delays or losses caused by incorrect details you supply.

Liability

To the extent permitted by Indian law, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential losses. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 that cannot be limited by agreement.

Complaints

Email info@thotavaikuntam.in with your order number; we will acknowledge within 48 hours and aim to resolve within 30 days [CONFIRM]. [CONFIRM: name and designation of a grievance officer, as the Consumer Protection (E-Commerce) Rules, 2020 require an e-commerce entity to publish.]

Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana [CONFIRM jurisdiction with counsel].
